Terms and Conditions

1. Scope of Application For all orders via our online shop, the following terms and conditions apply. Our online shop is exclusively for consumers. A consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity. An entrepreneur is a natural or legal person or a legally responsible partnership that, when concluding a legal transaction, acts in the exercise of its commercial or independent professional activity.

2. Contractual Partner, Conclusion of Contract, Correction Options The purchase contract is concluded with DUNEGLAM. By placing the products in the online shop, we make a binding offer to conclude a contract for these products. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained for this purpose in the ordering process. The contract is concluded by clicking on the order button to accept the offer for the products contained in the shopping cart. Immediately after sending the order, you will receive a confirmation by email.

3. Contract Language, Contract Text Storage The language(s) available for concluding the contract: German, English We save the text of the contract and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

4. Delivery Conditions 4.1 Shipping Costs In addition to the prices stated for the products, shipping costs are added for standard shipping. You can find out more about the amount of the shipping costs in the offers. For express delivery, a surcharge of 15 euros applies. You can find more detailed provisions on express delivery in the offers. 4.2 Delivery Options We ship the products to the delivery address specified during the ordering process. We only deliver by mail. Unfortunately, self-collection of the goods is not possible. We do not deliver to packing stations.

5. Payment 5.1 Prices The prices stated at the time of the order apply. These are total prices and include the statutory value-added tax. 5.2 Payment Methods The following payment methods are generally available in our shop. Advance Payment: If you choose the payment method advance payment, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment. Cash payment upon collection: You pay the invoice amount when you collect it in cash. Credit card: You enter your credit card details during the ordering process. Your card will be charged immediately after placing the order. SEPA Direct Debit: By placing the order, you give us a SEPA direct debit mandate. We will inform you about the date of debiting the account at least one bank working day in advance (so-called pre-notification). A bank working day is every working day except Saturdays, federal holidays, and December 24th and 31st of each year. The account will be debited before the goods are shipped. PayPal, PayPal Express: In order to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data, and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. Further information will be provided during the ordering process. PayPal may offer other payment methods to registered PayPal customers according to its own criteria. However, we have no influence on the offering of these modalities; further individually offered payment modalities concern your legal relationship with PayPal. 6. Warranty and Guarantees​​​​​​​ 6.1 Warranty Rights The statutory warranty rights apply. 6.2 Guarantees and Customer Service Information on any additional guarantees and their exact conditions can be found with the respective product and on special information pages in the online shop.

7. Dispute Resolution​​​​​​​ The European Commission provides a platform for online dispute resolution (OS), which you can find here. We are not obligated and unwilling to participate in dispute resolution proceedings before a consumer arbitration board.

8. OUR CONTRACT AND HOW THE CONTRACT IS FORMED:
   
   This Website is operated by Duneglam. If you have any questions, whether about our products and services, this Website or otherwise, please contact our Customer Service team.After placing an order, you will receive an email from Duneglam acknowledging that we have received your order (the “Order Confirmation”). Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product or service. All orders are subject to acceptance by Duneglam, and we will confirm such acceptance to you by sending you an email that confirms that the products have been dispatched (the 'Dispatch Confirmation'). The contract between us (the “Contract”) will only be formed when we send you the Dispatch Confirmation. The Contract will relate only to those products whose dispatch we have confirmed.

9. PRODUCTS AND SERVICES FOR PERSONAL USE
   
   The products and services available on the Website, and any samples thereof we may provide to you, are for personal and/or professional use only. You may not sell or resell any of the products or services, or samples thereof, you purchase or otherwise receive from us. We reserve the right, with or without notice, to cancel or reduce the quantity of any order to be filled or products or services to be provided to you that we believe, in our sole discretion, may result in the violation of our Terms.

10. PRICING AND WEBSITE ERRORS
    
    Whilst we try and ensure that all details, descriptions, and prices which appear on this Website are accurate, typographical errors or other errors and may not always be complete or current. We therefore reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time without prior notice. We reserve the right to cancel or complete delivery of any orders that you may place based on information on the Website that may contain errors or inaccuracies, including, without limitation, errors, inaccuracies or out-of-date information regarding pricing, shipping, payment terms, or return policies. If we discover an error in the price of any goods which you have ordered, we will inform you of this as soon as possible and a refund will be processed. You can then choose if you wish to place a new order at the correct price.. When ordering products or services through the Website, please note that:
    
    • orders will only be accepted if there are no material errors in the description of the goods or services or their prices as advertised on this Website;

11. • all prices are displayed in your local currency and local tax where applicable unless expressly indicated otherwise;

    • packaging may vary from that shown on the Website;

    • the weights, dimensions and capacities shown on the Website are approximate only;

    • whilst we try to display the colours of our products accurately on the Website, the actual colours you see will depend on your monitor and we cannot guarantee that your monitor's display of any colour will accurately reflect the colour of the product on delivery; and

    • all items are subject to availability. We will inform you as soon as possible if the product(s) or service(s) you have ordered are not available and we may offer alternative product(s) or service(s) of equal or higher quality and value.

    The prices on the Website include VAT but exclude delivery costs, which will be added to the total amount due. Prices are liable to change at any time, but (other than as set out above) changes will not affect orders in respect of which we have already sent you an Order Confirmation. You may pay using Afterpay, ClearPay, PayPal Visa, Mastercard, Discover, and American Express and Duneglam store credit. Your credit/debit card payment will be made through a secure transaction. All payments are subject to authorisation by the card issuer. Card payments are subject to validation checks and authorisation by your card issuer. If your card issuer fails to authorise the payment to us, we will not be liable for any delay or non-delivery and may not be able to form a Contract with you or we will not be able to proceed with your order. Duneglam must receive full payment for the order at the time the order is processed and before the product is dispatched. A Dispatch Confirmation email will then be sent you.

12. EXCHANGES:
    
    For hygiene purposes we do not have an exchange policy, any items that are eligible to be returned can be returned for a refund only. If you need an alternative product, you will need to return the items first and then place a new order.

13. CANCELLATION REQUESTS:
    
    Unfortunately, we cannot always accommodate cancelation requests. We will try our best to assist but after a certain stage of order processing it can no longer be cancelled. We aim to ship orders as fast as we can so although you may message us immediately after placing your order, unfortunately it doesn't always guarantee cancelation. The cancelation request has to be reviewed and the request is sent to our warehouse processing team. If you would like to attempt cancelation of an order, please send us the Order Number to be cancelled and include the message: Please Cancel My Order. This will help us prioritise your email. You can do this via the Contact form or email us at info@duneglam.com. If we are unable to cancel your order, your items may still be eligible for return, you can check out our returns policy here.

14. YOUR ORDER DELIVERY
    
    Subject to the STOCK AVAILABILITY clause above, we will endeavour to fulfil your order for product(s) listed in the Order Confirmation within a reasonable period of time unless there are exceptional circumstances. If for any reason we cannot meet the delivery date, you will be kept informed and offered a choice of either continuing with the extended delivery time or cancellation with a full refund. Once your order has been dispatched, we will email you the details of your order to the email address provided. For the purpose of these Terms, “delivery” or “delivered” shall be deemed to have occurred upon delivery of the product (s) at the address specified by you when you completed your order or at a selected Duneglam or such other delivery method as shall be agreed between you and us. If you wish to send products to different addresses you must create a different order for each delivery address.

15. YOUR OBLIGATIONS AND RESPONSIBILITIES
    
    By accessing or using the Website or any Content, you agree that you will comply with these Terms and any warnings or instructions on the Website. You agree that when accessing or using the Website or any Content, you will act in accordance with the law, custom and in good faith. You may not make any change or alteration to the Website or any Content or services that may appear on this Website and may not impair in any way the integrity or operation of the Website. Without limiting the generality of any other provision of these Terms, if you default negligently or wilfully in any of the obligations set forth in these Terms, you shall be liable for all the losses and damages that this may cause to us, our parents, subsidiaries, affiliates, partners or licensors.

16. RISK AND TITLE
    
    Any products ordered will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges, or upon delivery, whichever is later.

17. SEVERABILITY
    
    If any of these Terms or any provisions of a contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.

18. ENTIRE AGREEMENT
    
    The above Terms constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and DUNEGLAM. Any waiver of any provision of the Terms will be effective only if in writing and signed by a Director of DUNEGLAM. All contracts for the purchase and sale of DUNEGLAM products from the Website shall be concluded in the language of these Terms.
